--------  Products Return Policy --------

These terms and conditions of purchase are an agreement between you and RefreshYOU. These terms and conditions of purchase, the terms of use of the sites owned and controlled by RefreshYOU (the “sites”) and RefreshYOU’s privacy policy (together, the “terms of purchase”) govern any order or purchase you makes on the sites.

Please carefully read the following terms, the terms of use and the privacy policy which are hereby incorporated by reference. By indicating your agreement to be bound by these terms of purchase, you agree to be bound by these terms and conditions of purchase and the terms of use and to the collection, use and disclosure of your personal information in accordance with the privacy policy, and you enter into a legally binding agreement with RefreshYOU.

1. Acceptance of orders

Only residents of Canada who have reached the age of majority in their province of residence may place orders through the sites. Product orders are available to be shipped within Canada only. Your order will be deemed to be accepted only if and when we send a confirmation of the terms of your order to your email address and will be subject to these terms of purchase and the additional terms and conditions included in your order.

We may limit quantities available for sale or sold, and we reserve the right at any time to reject or correct any order for any reason whatsoever. Unless otherwise indicated, all prices and other amounts are in Canadian dollars.

2. Shipping and delivery

The delivery date of your purchase depends on the shipping method you have chosen. Our shipping process and options that you may have with regard to shipment, including delivery method, carrier and estimated date of delivery or time for delivery, are described during the purchase process, but we reserve the right to use a substitute carrier for your purchase at any time, at our discretion.

3. Methods of payment

You can pay for any purchase you make online by using a mastercard, visa or american express card, or by using a paypal account. By submitting your payment by credit card, you authorize refreshyou to charge the applicable card for the total amount of your order and you represent and warrant that you are the cardholder of the applicable card. If your card is rejected by the card issuer, your order will not be accepted and RefreshYOU will have no obligation to fulfill your order.

4. Products

We do not guarantee any of our products or their claims. If skin irritation occurs stop using the products immediately.

5. Refunds and returns

We have a 14-day return policy on unopened packaging only. Which means you have 14 days after receiving your item to request a return only if you have not opened and/or used the product. To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase. To start a return, you can contact us at info@refreshevolution.com. If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

Damages and issues

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Exceptions / non-returnable items

We cannot take opened and/or used products due to the nature of our products. If you have any questions please email info@refreshevolution.com. Unfortunately, we cannot accept returns on sale items or gift cards.

Exchanges

The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.

Refunds

We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method. Please remember it can take some time for your bank or credit card company to process and post the refund too.

Admissions policy

The admissions policy supports refreshyou in its efforts to enroll students who meet program admission, and program requirements, and who are likely to succeed in achieving their education goals. The policy also is set to:

• Define the criteria the applicant must satisfy all requirements in order to be considered for admission to refreshyou.

• Create clear expectations of our curriculum and standard of behavior.

General admission requirements:

• Certificate of high school completion or acceptable equivalent.

• Must be minimum of 18 years of age.

• Completed and submitted your application to the school.

• Completed an interview with our admissions director.

At the time of enrolment student must be a minimum of 18 years of age.

Applicant residency:

All canadian residents are welcome to apply. We accept international students with advanced english.

Program entrance requirements

Once an applicant has met the refreshyou application requirements, they then must meet the program requirements applicable to the course they are studying.

• Efficient english reading and writing

• Ability to take exams/tests provided

• Able to fulfil all hours required for completion of the course

• Ability to stand for extended periods of time

• Have payment in full or financing in place

Terms:

Refreshyou institute of medical aesthetics is held free of blame:

If you do not meet the minimum requirements and passing grade set forth by refreshyou institute of medical aesthetics.

If you fail to complete the online course.

​

If you fail to come for hands on training or fail to make final payment with programs.

​

Courses and deposits for programs are non refundable and refreshyou institute of medical aesthetics is held free of blame.

5. Withdrawl & refund

It is the student's responsibility to become familiar with the policies and procedures which outline refreshyou course fee withdrawals and refunds. Students considering a course withdrawal are strongly advised to consult with their program coordinator. 

Important: not attending classes or notifying only your instructor or program

Coordinator of your intent to withdraw are not acceptable methods for formally withdrawing from a class or program. A student may not withdraw from their program by dropping courses. 

Refreshyou students should check with the program advisor, as withdrawing may affect their current or future refreshyou status. If students withdraw after the refund date, they are responsible for any outstanding fees and for repayment of funds to refreshyou.

Program withdrawals must be submitted to the director of education in person or email to info@refreshevolution.com by submitting a completed withdrawal form or letter from the student. If the withdrawal form or letter is submitted within seven (7) days of the course start date, refreshyou refunds 90% of the course cost. Full refunds will be given to students that withdraw prior to one week before the course starts.

There are no refunds after the official start day of each course.

Please note: fees paid by interac e-transfer, web banking, credit card and debit card will be refunded by interac e-transfer.

Refreshyou reserves the right to not refund at any point if the “respectful and fair treatment of students and staff policy” is violated.

If we cancel a training course, or change course content: - we reserve the right to cancel a training course at any time, without incurring any additional liability to the licensor or any delegate. In such circumstances, we will offer alternative dates, a full refund or a credit note.

Conditions:

Job placement is not guaranteed. However, we may offer a position at one of our four clinical locations to skilled students if there is an available opening.

Abide by all of the rules and guidelines set forth within your course and program.

​

You must be 18 years or older, and in good health, both mentally and physically.

​

Please make sure you keep a copy of your certificate.

We do not keep copies and there is a fee of $50 to reissue certificates.

​

It is the students responsibility to follow through and complete their course's and or programs.

It is not RefreshYOU Institute of Medical Aesthetics’ responsibility to follow through if the student has not completed the course and or program.

6. Errors

If we discover that a product’s price, description or specifications are misstated or incorrect, we will endeavour to correct the error on our sites. If we make an error with regard to your order, we may correct or cancel an order at any time, and/or edit an order to reflect the correction (you will have the right to approve or confirm any increase in price or shipping charges).

7. Disclaimers, liability exclusions/limitations on liability and indemnity

Other than for express, legal or implied warranties that may not be disclaimer or excluded under applicable law, the products and services you purchase through the sites are provided on an "as is" and "as available" basis, without any representations, warranties or conditions of any kind. RefreshYOU and its suppliers are not liable for any indirect, incidental, consequential, special, punitive or exemplary loss or damage arising from, connected with, or relating to the products or services you purchase or these terms of purchase including but not limited to loss of data, business, markets, savings, income, profits, use, production, reputation or goodwill, anticipated or otherwise, or economic loss, under any theory of liability (whether in contract, tort, civil liability, strict liability or any other theory or law or equity).

8. Privacy

RefreshYOU collects, uses and discloses personal information in accordance with its privacy policy. By accepting these terms of purchase, you consent to RefreshYOU's collection, use and disclosure of personal information in accordance with this privacy policy as it then reads.

9. General

These terms of purchase and all related matters are governed solely by the laws of the province of Quebec, without reference to its conflict of laws provisions, and the federal laws of Canada applicable therein. Any dispute arising from, connected with or relating to these terms of purchase, or any related matters ("disputes") will be resolved by the laws of the province of Ontario, Canada, and you hereby irrevocably submit and attorn to the original and exclusive jurisdiction of those courts in respect of all disputes.

If any provision of these terms of purchase is held to be invalid or unenforceable for any reason, then the provision will be deemed to be severed from these terms of purchase and the remaining provisions will continue in full force and effect.

These terms of purchase ensure the benefit of RefreshYOU and its successors, assigns and related persons. You may not assign any rights or obligations that you have under these terms of purchase. RefreshYOU may assign its rights and obligations under these terms of purchase without your consent.

No consent or waiver by any party to or of any breach or default by any other party in its performance of its obligations under these terms of purchase will be: (a) deemed or construed to be a consent to or waiver of a continuing breach or default or any other breach or default of those or any other obligations of that party; or (b) effective unless in writing and signed by all parties.

The parties have expressly requested and required that these terms of purchase and all other related documents be drawn up in the english language. Les parties conviennent et exigent expressément que ces conditions d'usage et tous les documents qui s'y rapportent soient rédigés en anglais.​​

You have a right to change/update your personal information at any time by contacting RefreshYOU.

By supplying your phone number you consent to receive phone calls or text messages from RefreshYOU Institute of Medical Aesthetics and Refresh Evolution Franchise.

By supplying your email address you consent to receive emails and electronic communications from RefreshYOU Institute of Medical Aesthetics and Refresh Evolution Franchise.

----- Limitation of Liability -----

To the fullest extent permitted by law, RefreshYOU will not be liable for any damages of any kind arising out of or in connection with your participation or membership in the program, including damages arising out of changes to or termination of the program. This is a comprehensive limitation of liability that applies to all damages of any kind, including but not limited to direct, indirect, incidental, punitive or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. To the extent permitted by law, the limitations on RefreshYOU's liability set forth herein shall apply whether for breach or repudiation of contract, or whether in tort, civil liability by way of negligence, gross negligence, strict liability, or otherwise, even if advised of the possibility of such damage. By agreeing to these terms, you willingly agree (or, if you are a minor, your parent or legal guardian willingly agrees) that you have relinquished your right to seek these damages from RefreshYOU and that this is a reasonable allocation of risk. This provision does not apply to new jersey residents.

All program design, text, graphics, logos, button icons, images, audio clips, the selection and arrangement thereof, and all proprietary software is copyright (c) 2023 refreshyou, all rights reserved. The compilation (meaning the collection, arrangement and assembly) of all program content is the exclusive property of refreshyou and protected by canada, u.s. and international copyright laws. All software used in connection with the program is the property of refreshyou or its software suppliers and is protected by canada, u.s. and international copyright laws. Unless otherwise indicated in part of the program materials, permission is granted to electronically copy and to print in hard copy portions of the program materials for the sole purpose of accessing the program and the services provided therein for personal use. Any other use of program materials - including reproduction, modification, distribution, republishing, transmission, displayer performance - without the prior written permission of refreshyou is strictly prohibited.

--- Resolving Disputes ---

If a dispute should arise between you and refreshyou, we want to provide you with a resolution that is efficient and cost effective. In our experience, almost all customer service disputes can be resolved to your satisfaction by our customer service team, reachable by emailing info@refreshyou.ca. 

If your dispute cannot be resolved using our customer service team, these terms describe how we shall proceed with the resolution of the dispute. 

To the extent permitted by applicable laws, you and refreshyou agree that any cause of action must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred. The preceding sentence does not apply to new jersey residents.

We have the right to revise and amend these terms and conditions from time to time.
